Terms of Service

These Terms of Service ("Terms") govern the use of the VB Agent Builder platform, a product of Virtual Boost ("we", "us", or "the platform"), available at vbagentbuilder.com. By creating an account or using the service, you ("Subscriber" or "you") agree to these Terms. If you do not agree, do not use the platform.

1. Description of the service

The platform lets you build, train, and operate AI customer-service agents integrated with messaging channels (WhatsApp, Instagram Direct, Facebook Messenger, Telegram, and a website widget) and with third-party services (such as Google Calendar), plus a support inbox, reports, and usage-based billing. We may evolve, change, or discontinue features at any time, aiming to give reasonable notice when a change is material.

2. Registration and account

• You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account.
• The service is intended for businesses and people over 18.
• Notify us immediately of any unauthorized use of your account.

3. Plans, credits, and payment

• Use is billed through subscription plans and/or credit packs, according to the prices shown on the platform.
• Credits are consumed by agent usage (for example, per processed message), depending on the AI model and configured capacity.
• Subscriptions renew automatically for the contracted period until canceled. Payment processing is handled by a third-party provider.
• Unless required by law or expressly stated, amounts paid and credits consumed are non-refundable. Credits may have an expiration date where indicated.

4. Acceptable use

You agree not to use the platform to:

• Send spam, unsolicited bulk messages, or violate the policies of the integrated channels (Meta/WhatsApp, Telegram, Google);
• Engage in illegal, fraudulent, or deceptive activities, or infringe third-party rights;
• Distribute malware, attempt to bypass limits, overload, or compromise the security of the platform;
• Collect or process third-party personal data without an adequate legal basis.

Non-compliance may lead to suspension or termination of the account.

5. Third-party integrations

The platform integrates with third-party services — including Meta (Facebook, Instagram, WhatsApp), Google (Google Calendar), AI providers (such as Anthropic and OpenAI), and the payment provider. By connecting these services, you also agree to their respective terms and policies and are responsible for maintaining the necessary authorizations. We are not liable for outages, changes, or decisions of these third parties that affect the integrations.

6. Subscriber content and responsibility

• You are responsible for the content you configure (instructions, knowledge base, messages) and for the responses your agents generate to your end customers.
• AI responses may contain inaccuracies; you must review and supervise sensitive uses. The platform is a tool and does not replace professional advice (legal, medical, financial, etc.).
• Regarding your end customers' data, you act as controller and we as processor, as described in the Privacy Policy.

7. Intellectual property

The platform, its brand, software, and materials are owned by or licensed to us. We grant you a limited, non-exclusive, non-transferable license to use the service under these Terms. You retain ownership of the content you input, granting us the license necessary to operate the service.

8. Privacy

The processing of personal data is governed by our Privacy Policy, which forms part of these Terms.

9. Disclaimer of warranties

The service is provided "as is" and "as available", without warranties that it will be uninterrupted, error-free, or fit for a particular purpose, to the maximum extent permitted by applicable law.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental damages, lost profits, or data loss. Our total liability, where applicable, is limited to the amount you paid in the 3 (three) months prior to the event giving rise to the claim.

11. Suspension and termination

You may close your account at any time. We may suspend or terminate access in case of a breach of these Terms, security risk, or legal requirement. After termination, data is handled as described in the Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through our usual channels, and the "Last updated" date will be revised. Continued use after changes means acceptance.

13. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil, with the competent courts as defined by applicable law.
